Welcome to PAVO ("Personal AI Voyage Organizer"). These Terms of Service ("Terms") govern your use of the PAVO mobile application and related services (collectively, the "Service") operated by Studio Hedera ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. AI-Generated Content Disclaimer

1.1 No Warranty of Accuracy

AI-generated content provided through the Service:

• May contain inaccuracies, errors, or outdated information
• Is not verified by human experts
• Should not be relied upon as the sole source of information for travel decisions
• May not reflect current business hours, locations, or availability of recommended establishments
• May include fictional or hallucinated information

1.2 User Responsibility

You acknowledge and agree that:

• You are solely responsible for verifying the accuracy of all AI-generated information
• You should cross-reference recommendations with official sources before making decisions
• We are not responsible for any consequences arising from your reliance on AI-generated content

2. Limitation of Liability

2.1 No Liability for AI Errors

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

• Damages arising from inaccurate, incomplete, or misleading AI-generated content
• Loss of time, inconvenience, or expenses incurred due to incorrect recommendations
• Personal injury, property damage, or any other harm resulting from following AI-generated guidance
• Business losses, lost profits, or consequential damages of any kind

2.2 Maximum Liability Cap

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

3. Credit-Based Pricing

3.1 Credit System

The Service operates on a credit-based model:

• Each AI-generated story or recommendation consumes one (1) credit
• Web search-enhanced generation ("Web Mode") may consume additional credits
• Credits are non-refundable and non-transferable
• Unused credits do not expire unless otherwise stated in your purchase

3.2 Pricing Plans

Current pricing (subject to change with notice):

• Starter Pack: $9.99 for 10 credits
• Traveler Pack: $19.99 for 25 credits
• Explorer Pack: $39.99 for 60 credits
• Premium Subscription: $49.99/month for up to 150 credits per month (fair use policy applies)

3.3 No Refunds

All credit purchases are final and non-refundable, except as required by applicable law. We do not provide refunds for:

• Unused credits
• Credits used for AI-generated content you deem unsatisfactory
• Service interruptions or technical issues (we may provide credit compensation at our discretion)

4. Location Services

4.1 Location Permissions

The Service requires access to your device's location services to function properly. By using the Service, you consent to:

• Continuous collection of your precise GPS location while the app is active
• Processing of location data to generate relevant local content
• Temporary storage of location data for service functionality

4.2 Location Accuracy

We do not guarantee the accuracy of location-based services. GPS and network-based location can be affected by various factors including device settings, environmental conditions, and technical limitations.

5. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law
• Attempt to reverse engineer, decompile, or extract the AI models or algorithms used in the Service
• Use automated systems (bots, scrapers) to access the Service
• Share your account credentials with others
• Exploit the Service to generate content for commercial redistribution without our written permission
• Abuse the credit system through fraudulent purchases or chargebacks

6. Service Availability

6.1 No Guarantee of Uptime

We do not guarantee that the Service will be available at all times. The Service may be interrupted, suspended, or terminated at any time without notice due to:

• Scheduled or emergency maintenance
• Technical issues with third-party services (Google, AWS, Mapbox)
• Force majeure events
• Business decisions

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

7. Third-Party Services

The Service integrates with third-party services, including but not limited to:

• Google Gemini API: AI content generation
• Amazon Polly: Text-to-speech synthesis
• Mapbox: Maps and geocoding
• Firebase: Backend infrastructure

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, content, or policies of these third parties.

8. Intellectual Property

8.1 Our Rights

The Service, including its design, features, text, graphics, logos, and software, is owned by Studio Hedera and protected by copyright, trademark, and other intellectual property laws.

8.2 AI-Generated Content Ownership

Content generated by AI for your personal use through the Service is provided for your personal, non-commercial use only. We do not claim ownership of AI-generated content, but you acknowledge that such content may be similar or identical to content generated for other users due to the nature of AI systems.

9. Indemnification

You agree to indemnify, defend, and hold harmless Studio Hedera, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any actions taken based on AI-generated content

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Japan Commercial Arbitration Association, except as otherwise required by applicable law (e.g., EU consumer protection laws).

10.3 EU Consumer Rights

If you are a consumer in the European Union, you benefit from mandatory consumer protection provisions under EU law, and nothing in these Terms affects your statutory rights.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Displaying an in-app notification
• Sending an email (if you have provided one)

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease, and any unused credits will be forfeited.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Studio Hedera regarding the Service and supersede all prior agreements and understandings.
